Mitchell Huberman is a trial lawyer at the criminal law firm, Smith Litkowski. He defends individuals facing criminal charges ranging from mischief to murder. Mitchell also practices prison law with notable expertise in representing inmates at parole hearings and faint hope hearings.

Mitchell has acted as counsel in many judge-alone and jury trials. He has successfully defended clients charged with a variety of offences, including robbery, forcible confinement, dangerous driving, impaired driving, mischief, theft, drug trafficking, domestic assault, uttering threats, assault with a weapon, aggravated assault, sexual assault, sexual interference, child luring and other internet offences, unlawfully possessing or trafficking firearms, break and enter, breaching court orders, manslaughter, attempted murder, and first- degree murder.

Mitchell also maintains a prison law practice where he helps clients navigate the correctional system. He conducts many parole hearings each year and has secured a release for numerous clients serving penitentiary sentences. As a proud advocate for rehabilitation, Mitchell also works with clients serving life sentences to help them prepare applications for judicial review (i.e., faint hope applications) in pursuit of reducing their parole ineligibility period. He has had notable success in obtaining earlier parole eligibility dates for his clients who have brought said applications.

In 2021, Mitchell brought a constitutional challenge to the parole and statutory release regime in Canada. Mitchell challenged the law that governs when an offender has a right to a post-suspension hearing following an alleged breach of their parole or statutory release, which would determine whether or not that offender can be re-released back into the community. As a result of the constitutional challenge, the Parole Board of Canada formally changed its policy to mirror Mitchell’s arguments in court thereby ensuring more timely post-suspension hearings for all offenders who have had their parole or statutory release suspended.

Mitchell received his Juris Doctor at Dalhousie University’s Schulich School of Law. During law school, Mitchell worked with the Seventh Step Society of Nova Scotia, an organization that assists with reintegrating offenders back into the community and also worked as a researcher in criminal procedure assisting with drafting the criminal procedure textbook.
